00:00The federal court on Wednesday reduced the jail sentence of former IT officer Yu Weiliang
00:06from 16 years to 12 years over a fatal road rage incident six years ago.
00:12The 47-year-old Yu sobbed in the dock upon hearing the decision.
00:16Yu's lawyer Datuk N. Sivananthan said Yu was initially not optimistic,
00:21but was relieved with the outcome.
00:22He said Yu's face lit up when he met him in the dock immediately after the court decision.
00:28He said the sentence reduction was substantial and whatever it was,
00:32someone died and Yu was paying the price for the death.
00:35He said Yu will be released in 2027.
00:39In 2023, the Shah Alam High Court sentenced Yu to 16 years
00:43for causing the death of the then 29-year-old Syed Muhammad Daniel
00:48along the North-South Expressway near Bangi in August 2019.
00:53The incident began near the Sungai Besi toll plaza
00:55and escalated into a physical altercation.
00:59The victim allegedly alighted with a baseball bat and swung at the front of Yu's car,
01:04after which Yu rammed into him.
01:06The victim later died at Nilay Medical Center.
01:09The three-judge panel upheld Yu's conviction under Section 304, Subsection A of the Penal Code,
01:15but found the 16-year term excessive.
01:17They said the decision by the Court of Appeal was safe
01:20and there was no error for them to decide otherwise.
01:22They dismissed cross-appeals by both the defense and prosecution.
01:27The defense had hoped for a substitution to Section 304, Subsection B of the Penal Code,
01:32which provides a maximum 10-year imprisonment,
01:35while the prosecution sought to reinstate the murder charge
01:38under Section 302 of the Penal Code,
01:41which carries the death penalty,
01:43or a maximum 40-year jail term,
01:45and at least 12 strokes of the roten.
