00:23En october 5th we're going to be hearing oral argument in the United States Supreme Court
00:29in the case of Suncor v Boulder, and that's the case where the city and county of Boulder
00:33are seeking to recover from the oil companies the costs of responding to climate change.
00:42We need to figure out how to address that. We need to figure out how to address that in a
00:46very meaningful way.
00:47This litigation doesn't do that. This litigation is trying just to cast blame.
00:52It's not trying to address any issues in a meaningful way.
00:57The first possibility is the Supreme Court says this is too early for us to be involved
01:02and sends it back to the state courts. So that's one possibility.
01:07The second possibility is the Supreme Court rules in favor of the local governments
01:12and says it's okay for you to pursue your claims in state court under this tort theory
01:16and then lets the case proceed.
01:18And then the third possibility is that the Supreme Court rules in favor of Exxon and Suncor
01:23and says, no, the local governments can't bring this kind of case.
01:27This is basically a question of federal law in the Clean Air Act,
01:31and that would really create a significant barrier for the local governments
01:34in their efforts to recover these costs from the oil industry.
01:40Like communities all across the United States,
01:44Boulder has suffered greatly from big oil's climate lies.
01:48They now face staggering costs to protect residents from wildfires,
01:52droughts, extreme heat, and other climate harms these companies knew their products would make worse.
02:00This is the new normal for the people on the western slope.
02:05Springs drying up, ponds gone, creeks disappearing.
02:09It is very hard on ranchers, and it's very hard on livestock.
02:14It's also very hard on wildlife.
02:17In our state, we've seen a 300% increase in the number of bears being euthanized
02:22because they're starving to death.
