00:01The federal court has dismissed the Kedah government's bid to challenge a ruling that barred it from refusing to renew
00:07licences for pool betting and lottery operators.
00:10A three-member panel, chaired by Justice Rozaria Bujang, alongside Justices Colin Lawrence Sequeira and Azmi Arifin,
00:18ruled that legal questions raised by the state failed to meet the required threshold for determination.
00:24The legal questions centred on whether the courts could review the legality of the state government's decision and the extent
00:31of Kedah's powers under the federal constitution.
00:34The court also ordered the Kedah government to pay RM50,000 in costs.
00:38Last year, the Court of Appeal ruled in a majority decision that Kedah's move to deny licence renewals to pool
00:44betting agents and companies was unconstitutional.
00:47It stated that pool betting and lotteries fall strictly under the purview of the Finance Ministry.
00:52The appellate court held that refusing to renew premise licences had the effect of usurping the Finance Minister's power
00:59and imposing a blanket ban on pool betting and lotteries.
