00:00Well, first I want to say the following, with the same tranquility and serenity with which we received,
00:11in the first instance, a decision exemplar from the jueza Sandra Heredia,
00:18to condemn the president Álvaro Uribe, with that same serenity, I say,
00:24we received today the decision of a major part of the Superior Superior Tribunal,
00:34specifically from one of their halls, the Sala Penal.
00:37We have learned that in the long term for justice as victims and lawyers,
00:46we have learned to wait with all patience, with all tranquility,
00:55and also with the democratic talent that we characterize the different decisions,
01:03one in favor, one in favor, one in favor, like the one that is present today,
01:07that we respect as decision of the justice, but without doubt, we do not share.
01:14And this is the second aspect of what we want to say.
01:19In the majority decision of this Sala, we asserted, in first place,
01:26an absence of probatory valorization in the facts juridically relevant.
01:33The facts were ignored, in a way absolutely clear,
01:41the facts that, in our way of seeing, no only proof, no only proof,
01:46no only proof, pardon, proof, but proof, that are substantial,
01:52the pieces probatory, substantial, that obviously apuntan
01:58to the responsibility of Álvaro Uribe.
02:01In the beginning, because they were excluded the interceptations
02:06in which Álvaro Uribe and Diego Cadena sostienen conversations
02:11that comprometen that responsibility,
02:14a decision that, in the beginning, they were not shared.
02:18But, also, no only were ignored those proofs and those indications,
02:25but also that there was a clear, in the lecture of the magistrate,

04:13and a vote dissident in this moment and in this decision,
04:21is a contrast, in our way of view, absolute,
04:26with the majority position,
04:27in which there is a injudious and serious and rigorous valorization

04:38in a way quite clear and concreta,
04:41doctrinal,
04:43the affirmations hechas
04:45by the majority point.
04:49In that context, then,
04:52we announced clearly,
04:53as you can already deduce,
04:56that we will be able to apply to the recursion
04:59of the casation,
05:01that we will study even other contexts
05:03like the interamerican system
05:05of human rights,
05:06if it is the case.
05:08That we have not decided,
05:10but we understand
05:11that it is also a possibility.
